What’s changed in British citizenship by descent law 2025?
For decades, UK nationality laws discriminated against women. Before 1983, only British fathers could pass citizenship to their children. If a British mother had a child abroad (like in South Africa), that child missed out. The same child would have qualified if the father had been British.
This injustice led to the Romein case. The courts forced Parliament to correct the law.
Claim British Citizenship by Descent Through Your Grandmother
If your father could have become British through his mother (but the law blocked him), you may now qualify. The Home Office now treats your birth as if it had been registered at a British consulate at the time.
You can apply for British citizenship retrospectively. The only cost is the £130 ceremony fee. You no longer need to pay the £1,481 registration fee.
Once you become British, you can also register your children under 18 through the MN1 route.
Who can now qualify for British citizenship by descent?
You may qualify if you meet all of these conditions:
- You have a British paternal grandmother.
- Your father would have qualified if women could pass on citizenship.
- You were born between 1961 and 1983.
- You can provide documents to prove this.
