Introduction
If you were born in a former British colony — like Kenya, Southern Rhodesia (now Zimbabwe), or Zambia — and have a UK-born parent or grandparent, you may already qualify for British citizenship from former colonies. Many South Africans, Zimbabweans, Zambians, and Kenyans have ancestral ties to the UK but don’t realise they may be eligible for a British passport.
Real Case Example
One of our clients had a grandfather born in the UK and a father born in Kenya during colonial rule. The client himself was born in the early 1980s. He applied directly for a British passport — and received it without needing to register first.
How Is This Possible?
Because Kenya was a British colony at the time, his father was a Citizen of the United Kingdom and Colonies (CUKC). Under the nationality law then in force, he could pass on British citizenship by descent to children born abroad.
This route usually works if:
- The child was born before 1983 (when British nationality law changed), and
- The father was considered British under colonial rules.
What About British Mothers?
If your mother was British and your father was not, and you were born before 1 January 1983, you were not automatically British under the law at the time. But this unfairness has now been corrected.
Thanks to Section 4L of the British Nationality Act, you can now apply to be registered as a British citizen if:
- You would have become British if your mother had been allowed to pass it on
- You were born before 1983
- You missed out due to discrimination based on gender, marital status, or colonial policy
